On 17 July 1968, First Lieutenant Scully was deploying the men from his platoon to establish a portion of the company defensive perimeter when he was informed of enemy activity to his immediate front. He moved to a forward vantage point to pinpoint the hostile movement. When the company subsequently came under attack by an estimated North Vietnamese Army company, he steadfastly remained in his exposed position and reported location and size of the enemy unit to his commander. Undaunted by a heavy volume of hostile fire, Lt Scully resolutely continued his determined efforts until he was mortally wounded. His heroic and timely actions undoubtedly prevented casualties and enabled his company to subsequently repulse the enemy attack.

When the Marines suddenly came under a heavy volume of fire supporting the determined attack by the enemy, Lance Corporal Weaver moved to his machine gun and delivered devastating fire against the assaulting enemy soldiers, halting their advance and preventing a serious penetration of his unit's perimeter. Ignoring the hostile rounds impacting near him, he then concentrated his fire on stationary enemy emplacements and effectively silenced them. When his assistant gunner was seriously wounded, Lance Corporal Weaver skillfully continued operating his machine gun without assistance until his ammunition supply was exhausted. Disregarding his own safety, he fearlessly moved about the fire-swept area obtaining additional ammunition. Returning to his position, he resumed directing accurate fire against the hostile force and was seriously wounded. Steadfastly refusing medical evacuation, he resolutely remained in his position delivering highly effective suppressive fire until he was mortally wounded.

Corporal Hernandez was survived by his mother Josefina Lopez Hernandez, father Nieves Moreno Hernandez, three brothers, Carlos, Jesus, and Ernesto and sister Olivia. He is buried in Mont Meta Memorial Park, San Benito, Cameron County, Texas.
